Wellnaq User Terms & Conditions

1. Introduction & Acceptance

These User Terms & Conditions ("Terms") govern your access to and use of the Wellnaq platform, including the website, applications, dashboards, tools, and related services (collectively, the "Platform"), operated by Wellnaq Pte. Ltd., a company incorporated in Singapore ("Wellnaq", "we", "us", "our").

By creating an account, booking a consultation, making payment, or otherwise accessing the Platform, you confirm that you have read, understood, and agreed to be legally bound by these Terms.

If you do not agree, you must not use the Platform.

2. Platform Role & Disclaimer

2.1 Marketplace Only

Wellnaq is a technology platform and marketplace that facilitates the connection between users and independent wellness practitioners ("Practitioners").

Wellnaq:

  • Does not provide medical, healthcare, or therapeutic services
  • Does not employ, supervise, or control Practitioners
  • Does not guarantee outcomes, results, or effectiveness of consultations

All services are provided solely by Practitioners in their independent professional capacity.

2.2 No Medical Advice

Unless expressly stated and legally permitted, consultations offered through the Platform are for general wellness, educational, or informational purposes only and are not a substitute for professional medical diagnosis, treatment, or emergency care.

3. Eligibility & Account Responsibilities

You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Platform.

You agree to:

  • Provide accurate, complete, and up-to-date information
  • Maintain the confidentiality of your login credentials
  • Be fully responsible for all activity under your account

Wellnaq is not responsible for unauthorised account access resulting from your failure to secure your credentials.

4. Bookings, Payments & Refund Policy

4.1 Bookings

All consultations must be booked and conducted through the Platform. Any attempt to bypass the Platform is strictly prohibited.

4.2 Payments

Payments are processed via third-party payment service providers. Wellnaq does not store full payment card details.

4.3 Refunds & Cancellations

  • Cancellation requests made 24 hours or less before a scheduled consultation are eligible for a 50% refund only
  • No refunds will be issued for consultations that have already taken place
  • Full refunds may be granted solely at Wellnaq's discretion upon appeal and review

All refund decisions by Wellnaq are final.

5. User Conduct & Prohibited Activities

You agree not to:

  • Circumvent the Platform to engage Practitioners directly
  • Solicit or accept off-platform services from Practitioners
  • Misuse, disrupt, or interfere with Platform operations
  • Upload false, misleading, unlawful, or harmful content
  • Attempt to access unauthorised data or systems

Violation may result in immediate account suspension or termination without refund.

6. Practitioner Relationship & Disputes

6.1 Independent Practitioners

Practitioners listed on the Platform are independent professionals. Any advice, guidance, or services provided are the sole responsibility of the Practitioner.

6.2 Dispute Limitation

Wellnaq is not liable for:

  • Disputes between Users and Practitioners
  • Quality, safety, legality, or outcomes of Practitioner services
  • Any injury, loss, or damages arising from consultations

Wellnaq may, at its discretion, assist in facilitating communication but has no obligation to resolve disputes.

7. Limitation of Liability

To the maximum extent permitted by law:

  • Wellnaq shall not be liable for indirect, incidental, special, consequential, or punitive damages
  • Wellnaq's total liability shall not exceed the fees paid by you to Wellnaq in the three (3) months preceding the claim

This limitation applies regardless of the legal theory asserted.

8. Indemnity

You agree to indemnify and hold harmless Wellnaq, its directors, officers, employees, and affiliates from any claims, damages, losses, liabilities, and expenses arising from:

  • Your use of the Platform
  • Your interactions with Practitioners
  • Your violation of these Terms or applicable laws

9. Suspension & Termination

Wellnaq reserves the right to suspend or terminate your account at any time, with or without notice, for breach of these Terms or misuse of the Platform.

Termination does not affect accrued rights or obligations.

10. Intellectual Property

All Platform content, software, trademarks, and materials are owned by or licensed to Wellnaq. You may not copy, reproduce, modify, or distribute any content without prior written consent.

11. Amendments

Wellnaq may update these Terms from time to time. Continued use of the Platform constitutes acceptance of the updated Terms.

12. Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of the Republic of Singapore. Any disputes shall be subject to the exclusive jurisdiction of the Singapore courts.
